1. What FamiliaLista is

FamiliaLista is a digital tool that helps you organize your important information (accounts, documents, contacts, wishes, and messages) and, through a "check-in" system, deliver it to the people you designate if one day you stop responding.

FamiliaLista is not a lawyer, a notary, or a financial advisor. It is not a will, a trust, or a legal document, and it does not replace estate planning. For your will and your estate plan, consult a licensed professional.

2. Who can use it

You must be at least 18 years old and have the legal capacity to enter a contract. By using FamiliaLista you confirm this, and that the information you give us is truthful.

3. Your account

You are responsible for keeping your password secure and for all activity on your account. Keep your contact information current — the service depends on being able to reach you. Tell us right away if you believe someone else accessed your account.

4. Plans, payments, and cancellation

Building your manual is free. To activate your check-in you need a subscription plan. Payments are processed through Stripe; FamiliaLista does not store your card numbers.

Renewal. Subscriptions — monthly and annual — renew automatically at the end of each period until you cancel. You can see your renewal date and cancel anytime from your account. If we change prices, we'll tell you before the change affects your renewal.

Cancellation. Canceling stops future charges; your plan stays active until the end of the period you already paid for.

Refunds. Monthly plans are non-refundable — when you cancel, you keep the service through the end of the month you paid for. Annual plans come with a 30-day guarantee: if you cancel within 30 days of purchase, we refund the full payment; after 30 days, the year is non-refundable. Gifts are a one-time payment, do not renew, and are non-refundable once redeemed.

5. How the check-in and delivery work

When you activate your check-in, FamiliaLista contacts you periodically to confirm you're okay. If you stop responding, we send several reminders over a grace period that you configure. If you still don't confirm, FamiliaLista delivers your manual and your messages to the people you designated.

You are responsible for responding to your check-ins, and for keeping your cadence, grace period, contact details, and designated people accurate. Delivery is automatic and based on the configuration and contacts you gave us.

6. What FamiliaLista cannot guarantee

FamiliaLista is a tool, not a guarantee. Please read carefully:

• Delivery depends on third-party networks (WhatsApp, email, SMS). We cannot guarantee a message is delivered, read, or acted upon.
• There is a risk of a message sent in error, or of a late or failed delivery. By using the service, you accept these risks.
• FamiliaLista does not decide or intervene in what your family does with the information.
• FamiliaLista does not verify the accuracy of what you write in your manual.

7. Your content and acceptable use

The content you write in your manual is yours. You grant us permission to store, process, and deliver it solely to operate the service you configured.

Do not store real secrets — passwords, full card or account numbers, PINs. FamiliaLista is built to store pointers to where things are, not the credentials themselves. Do not use FamiliaLista for anything illegal or for information you don't have the right to share.

8. The people you designate

You choose your trusted people and recipients. It is your responsibility to choose well and keep their details accurate. By designating them, you confirm you have a legitimate relationship with them and reasonable grounds to share your information.

9. Privacy and security

Your manual content is stored encrypted. How we handle your information is explained in our Privacy Policy, which is part of these Terms.

10. Termination

You can close your account anytime. We may suspend or close an account that violates these Terms. If your account closes, your check-in is deactivated and your information is deleted in accordance with the Privacy Policy.

11. Disclaimer and limitation of liability

To the extent permitted by law, FamiliaLista is provided "as is", without warranties of any kind. We are not liable for indirect, incidental, or consequential damages, nor for messages sent in error, failed or delayed deliveries, or third-party network failures. Our total liability is limited to the amount you paid us in the 12 months before the event giving rise to the claim.

12. Indemnification

You agree to protect FamiliaLista against third-party claims arising from your use of the service, the information you uploaded, or your breach of these Terms.

13. Governing law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws rules. Any dispute will be resolved in the courts located in the State of Texas.

14. Changes to these Terms

We may update these Terms. If a change is significant, we'll let you know. Continuing to use FamiliaLista after a change means you accept it.
